GENERAL DESCRIPTION
Performs moderately complex legal work in the prosecution of quality-of-care enforcement cases at Informal Settlement Conferences (ISC) and at the State Office of Administrative Hearings (SOAH). Develops prosecution strategy for cases involving advanced medical issues and negotiates agreed settlement orders. Work involves litigation practice with legal writing and complex quality of care issues requiring knowledge of medicine. Works under general direction from the Manager of Litigation and Enforcement, with latitude for the use of initiative and independent judgment. Files complex quality of care cases at SOAH, including mediation of cases that do not resolve following ISC.
Prosecutes moderately complex to complex administrative enforcement cases at Informal Settlement Conferences (ISC). Work involves litigation practice with legal writing and knowledge of Board rules and the applicable Practice Acts for Physicians and Physician Assistants, and some work with other license types. Files administrative violation cases at SOAH, including mediation of cases that do not resolve following ISC. Works under general direction from the Manager of Litigation and Enforcement, with latitude for the use of initiative and independent judgment.
EXPERIENCE AND EDUCATION
· Graduation from an accredited law school with an L.L.B. or J.D. degree
· Litigation experience in moderately complex administrative, regulatory or health law, or moderately complex prosecutorial experience preferred
· Licensed in good standing to practice law in Texas for a minimum of two years
KNOWLEDGE, SKILLS, AND ABILITIES
· Knowledge of legal principles and practices of law related to the administrative law and the licensing and regulation of professionals, specifically licensees engaged in health care
· Knowledge of applicable law and rules regarding licensees of the agency
· Knowledge of legal principles and practices of law related to development of cases for litigation and prosecution
· Knowledge of Administrative Practice Act and Texas Rules of Civil Procedure
· Ability to interpret and apply laws
· Knowledge of medical terms and definitions
· Ability to conduct hearings
· Ability to conduct research and prepare cases
· Ability to communicate effectively both orally and in writing
· Ability to effectively manage multiple duties, set and meet deadlines
· Ability to work effectively in a team environment
WORK ENVIRONMENT REQUIREMENTS
· All applicants must be familiar with or have a willingness to learn Microsoft suite (e.g. Word, PowerPoint, SharePoint, Excel, and Microsoft Teams).
· All applicants assigned to an agency issued device (e.g. laptops, IPADS, cell phones) must use the agency device assigned to them to conduct agency business. The use of personal devices to perform official work responsibilities is not permitted unless formally approved.
PHYSICAL REQUIREMENTS AND/OR WORKING CONDITIONS
The principal job is performed in a standard office or remote environment and requires:
· All applicants must be available to work Monday-Friday during standard business hours in central time zone (CT), and must have regular and punctual attendance.
· All applicants will have prolonged periods of sitting and extensive computer screen time due to computer use.
· All applicants will have frequent use of keyboard, mouse, and other input devices.
· All applicants need to have the ability to participate in video calls, phone calls, and virtual meetings.
· All applicants may experience frequently working under deadlines, individually or as a team member, and at times may collaborate with others to meet deadlines.
· All applicants may generally experience low physical demands, occasional lifting of equipment up to a certain weight (e.g. 10-40 lbs.).
LEGAL REQUIREMENTS
· Cannot hold outside employment that interferes with assigned work schedule, nor does it constitute a conflict of interest with TMB employment and services.
· Must reside in Texas.
· Dual employment at another state agency or Texas public university is not permitted.
· A DPS background check will be conducted.
· If hired, must provide documentation(s) within three days of hire that establishes identity and employment verification.
· Compliance with all agency policies and procedures, including but not limited to applicable confidentiality, security and safety rules, regulations and standards.
